IN A FEW WORDS THE LENDER IS RIGHT AND THEY HAVE THE RIGHTS TO GET THEY MONEY BY INSTRUCTION A SOLICITOR
THE INTEREST RATE FOR THE TERM OF MORTGAGE ONLY APPLY TO THE FIXED TERM ?

AND IF THE FINANCIAL OMBUDSMAN FOOLING PUPILS THEN WHAT ELSE WE EXPECT
THE MORTGAGE TERM BY HSBC BANK AND RBS BANK AND MONEY MADE CLEAR GOV SIDE IS REFER TO THE FULL LENGTH OF YOUR MORTGAGE IE OVER 15-20 OR 25 YEARS BUT WITHIN THE FINANCIAL OMBUDSMAN TRY TO FOOL THE UK CONSUMER WHICH IS ALL MEANS A CRISS
following is my reasons to reject your
final decision
1-level of arrears was only 2 month by
the law and the agreement the lender has no right to take a legal
action as long the arrears is not more than 2 month specially when
there is agreeable arrangement and payment plan in place which I did
honour my payment plan in such a case legal action is totally illegal
and unfair and unreasonable in all means.
also this was the first miss payment
since I had my mortgage with Skipton 3 years ago by direct debit
payment with no single miss payment
totally unfair and illegal in all
means
for £350 mortgage payment in 2 moth
the lender charge £580 which is been add to the arrears which was
only 2 month miss payment plus there is already payment plan in place
so there is no any excuse to the lender to instruct a solicitor in
any way, the level of arrears again was only 2 month which is been
loaded by an illegal extra £580
2-as for Skipton to decide the
condition of payment
the lender never keep it's promises
what so ever and supplied misleading and wrong information all way
through when I asked to release the stage payment in 2009 the lender
stated the following lies
A- asking to keep the payment plan for
6 month before they release any further fund
which I have accepted and been done and
wasted 6 month by all means for nothing with clear intention from the
lender do no release any fund as promised
B-after the 6 month the lender did not
honer they word to release the fund as promised and came back with
another request story claiming I have to clear all of they unfair
charges which is been loaded to my account illegally even so and
again for the second time I did believe they lies and have cleared
and paid off all they illegal charges and another month been wasted
C- the lender for the third time
refused to release any fund and dishonourer they word and promises
asking for 6 month bank statement again more wast of times with no
excuses or reasons why they never asked for all of this information
from the beginning.
Again and for the third time 6 month
bank statement has been provided to the lender as requested and also
the financial ombudsman clearly stated at the time in they
confirmation letter that as soon as the lender receive this document
they will release the fund and I still have a copy from your letter
and again I did supplied 6 month bank statement another and another
month been wasted even so the lender refused to release any fund
D-for the fourth time the lender
refused to release any fund and ask for another request which is a
direct debit to be made before they release the fund again another
month been wasted and the direct debit been set as requested and also
you do have all of this information in file and even so the lender
refused to release any fund
E-all the information supplied include
6 month bank statement and direct debit payment and then the lender
after nearly a years of lies and misleading information and request
refused to release any fund claiming the reason is because I have
missed 2 payment last year according the letter which is again you do
have a copy of it which is been confirmed by your department
in all means you already have all of
this information in your file and knew that all of this information
has been supplied to the lender direct debit payment and 6 month bank
statement so what excuse are you given the lender for not releasing
the fund again I have to remain you with your last year letter which
clearly stated the lender will release the fund as soon as they
receive your bank statement and direct debit which I did at the time
last year and you never replied since and claimed you are so busy for
over a years and again I have supplied a copy of the lender refusal
to release any fund claiming it is to do with 2 month miss payment
the year before which is over 14 month ago again and by all means
very clear evidence to proof the misleading and lies by the lender
for over a year
Finally you also stated that you can't
see that I been charged the wrong interest and claim the rate has
expired in 2009,
with my all respect for sure you are a
qualified mortgage advisor and fore sure you knew from the mortgage
agreement that the word ( mortgage term ) clearly means the total
length of the mortgage offer and does not means any special period of
time such as tracker or discount or fixed rate mortgage simply the
mortgage term refer to the total length of the mortgage which is 25
years in my case and not 3 years as you claim
there is already another 50000 customer
has been simply over charged by Skipton who already claim the
increase of the interest rate is due to special current market
circumstance and never claim as you mention its' been set for fixed
or discount period
for sure I will take a legal action and
will submit a complaint about the level of service I have received by
all means from the Financial Ombudsman as I do believe you haven't
dealt with my case in any fair manner in any way what so ever and
ignored all the real clear fact that I have supplied along with all
requested information to the lender and also your previous letter
over a year ago claiming the lender will release the fund as soon as
they receive my direct debit agreement and 6 month bank statement
which I have already supplied at the time and for the fifth time the
lender didn't honour they promises and refuse to release any fund
and also ignored the real fact about the illegal charged which is
been add to my mortgage arrears for no reason and finally by claiming
that the mortgage term is for the first 3 years and ignored the
lender promise that the interest rat will never be more than 3.9%
over the mortgage term which is 25 years and not 3 years as stated .
